    Due to legal requirement, a user HAVE TO CONFIRM that want to subscribe to a newsletter list (in mailchimp).

    We find that there is no option and the subscription is automatical!

    How could we solve?

    The “most practical” way of achieving compliance, is to use the Terms & Condition agreement feature.

    Also, you can use the double opt-in option so users are required to confirm (via the email sent by MailChimp) before they are added to the list.

    Ok, I agree that the “most practical” way of achieving compliance, is to use the Terms & Condition agreement feature.

    BUT…… It is completely out of legal statement! In other words, it is a wrong way to set up the newsletter subscription, because of the obbligation to confirm in different field that the user want to receive newsletter. It must be a expressed and voluntary subscription!

    So, in my opinion, this functionality DOES NOT cover GDPR.

    And where, pray tell, is that stated in the GDPR? Purchasing a product is a voluntary act. And in making a purchase, a “business relationship” is established. At that point, the customer has the option to opt-out. The T&C solution achieves GDPR compliance, by disclosing the opt-out option to the customer.
