I noticed recently that for both eStore and eMember it is possible for people to pay for a product and go directly to Paypal without clicking the “I agree to the Terms & Conditions You must agree to the Terms & Conditions!” box. Also the “You must agree to the Terms & Conditions!” is permanently displayed even if nothing has been clicked,
Having read through similar problems on the forums, I guess this is a jQuery conflict issue. I tried de-activating all my plugins, one at a time, and this didn’t help. I read somewhere that I should set plugins up in no conflict mode, but I would welcome a pointer on how to do this.
My eStore version is 6.9.0.8 and my eMember is 8.4.3. WordPress is 3.5.
If you go to [http://markplex.com/markplex-membership] and click on the JOIN NOW you go directly to PayPal and “You must agree to the Terms & Conditions!” is permanently shown in red.

Click ‘add to cart’ for any of the products and then “Check out with Paypal” in the shopping cart.
Everything else seems to be working fine.

You have a few javascript issues on the page which is causing eMember’s javascript to not run correctly.
Uncaught SyntaxError: Unexpected token < wp-float-fixed.js:1
Uncaught TypeError: Object [object Object] has no method ‘slides’ general.js:3
The javascript code in all of our plugins are error free. Your theme or another plugin is most probably causing these errors and hence interfering with the proper functionality of the terms and conditions.
Do the following tests to see what is causing the conflict:
