We are required to present a disclaimer at checkout to CA residents before they pay. Is there a way to do this using a range of zip codes or (preferably) by the state CA perhaps in the same way as the sales tax and shipping is estimated.

What kind of disclaimer, exactly? I live in CA and know of no such mandate(s).

June 25, 2015 at 1:34 pm #70564wzpModeratorWhen I buy a Prop 65 product in a brick and mortar store, the “warning” is placed next to the product, in the aisle. The clerk does not tell me at checkout time, nor does the self-checkout screen “flash red,” when I scan the item. In a similar manner, you should just include the warning, as part of the product description.

June 25, 2015 at 9:27 pm #70566wzpModeratorUnless you are using Manual Checkout, there’s no way to learn the shipping state or zip code, until AFTER the payment IPN has been processed. The next best alternative is to put the Prop 65 warning in the Terms & Conditions, and require T&C agreement before checkout.
Background: For anyone else reading this… Prop(osition) 65, “The Safe Drinking Water and Toxic Enforcement Act of 1986,” is a voter initiated (“there ought to be a law”) law; requiring sellers of certain products to “warn” buyers of purchases that might contain carcinogens (cancer causing materials). Here’s an example of such a warning sign at my local Starbucks… “PROPOSITION 65 WARNING: Chemicals known to the State of California to cause cancer and reproductive toxicity, including acrylamide, are present in coffee, baked goods, and other foods or beverages sold here.”

Somehow doesn’t seem right that California ends up dictating what the rest of the world has to see. I notice that on the Manual Checkout the Terms & Conditions appear but not on the PayPal gateway setting. Can you help me with this?

I honestly think you are overthinking the compliance requirements… as it only requires you to post “Clear and Reasonable Warnings.” I strongly suggest you get a legal opinion; as over-compliance increases your estoppel risk. For instance, if you over-comply with Prop 65, you are fair-game for being asked by a certain government, to not process (and to report any) orders from their citizens that occur on the Sabbath. The estoppel argument would be something like… because you went over and beyond to comply with “that” requirement, you should do the same for ours.

- You will be “on your own,” as far as support for any modifications go.
- You will have to modify the addon to detect any IP addresses that originate within CA.
